Terms of Service

These Terms of Service ("Terms") govern your access to and use of The SignalDesk website at thesignaldesk.io, members area, trading software, alerts, videos and related services (together, the "Service"), provided by BRNDZ ("SignalDesk," "we," "us"). By creating an account, subscribing, opting in or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What SignalDesk is, and what it is not
SignalDesk is a decision-support and educational tool for futures traders. It analyzes market data, identifies setups that meet its rules, and displays signals, stop and target levels, and coaching commands. SignalDesk does not place trades, does not have access to your brokerage account, and does not manage money for anyone.
Nothing in the Service is investment, financial, tax or legal advice, or a recommendation that any person buy or sell any futures contract or other instrument. Signals and commands are general and impersonal; they are not tailored to your finances, objectives or risk tolerance. You alone decide whether to trade, what size to trade, and when to exit.
2. Risk
Futures trading involves substantial risk of loss and is not suitable for every investor. You can lose more than your initial deposit. Past performance, whether actual or hypothetical, is not indicative of future results. Read our Risk Disclosure, which is part of these Terms.
3. Eligibility and your account
You must be at least 18 years old and able to form a binding contract. Give us accurate information and keep it current. You are responsible for your password and everything done under your account. Your subscription is for one person. You may not share your login, and we may suspend accounts that are shared or used from an unusual number of devices or locations. Tell us right away at [email protected] if you suspect unauthorized use.
4. Subscriptions and payment
Access is sold as a subscription at the price and billing period shown at checkout. You authorize us and our payment processor to charge your payment method at the start of each billing period until you cancel. You can cancel at any time from your account; access continues until the end of the period you paid for. Prices are in US dollars and do not include taxes. We may change prices for future billing periods with at least 30 days' notice by email.
Refunds: you can cancel at any time and keep access until the end of the period you paid for. Fees already paid for a billing period are not refunded.
5. Your license to the software and content
While your subscription is active, we grant you a personal, non-exclusive, non-transferable license to use the Service for your own trading. All software, signals, commands, videos, text and designs are owned by SignalDesk or its licensors. You may not copy, resell, rebroadcast, publish or share signals, commands, levels or videos, including in chat rooms, social media, Discord or Telegram groups, or signal-copying services. You may not reverse engineer, decompile, or attempt to derive the system's logic.
6. Platform and data
The Service runs on your charting platform and depends on market data, charting platforms, brokers, internet connections and other services outside our control. Data can be delayed, incomplete or wrong. Signals may be late, missed or not delivered. The News Guard covers only the economic releases we list and only pauses new signals; open positions and your broker's or prop firm's rules are your responsibility.
7. Results, testimonials and examples
Trade examples, sample levels, charts and videos are for illustration. Testimonials reflect individual experiences, are self-reported unless we say otherwise, and are not typical. We do not promise that you will make money or avoid losses.
8. Acceptable use
You may not use the Service unlawfully, interfere with or probe its security, scrape it, share or resell access, or use it to build a competing product.
9. Communications
By opting in or creating an account you agree to receive emails about your account and, if you choose, marketing emails, which you can unsubscribe from at any time. Text messages are covered by our SMS Terms and need your separate consent; checking the box is optional and is not a condition of any purchase.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, timely, error-free or profitable.
11. Limitation of liability
To the fullest extent the law allows, SignalDesk is not liable for any trading losses, lost profits, or indirect, incidental, special, consequential or punitive damages arising from your use of the Service, even if we were told they were possible. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
12. Indemnity
You agree to defend and indemnify SignalDesk against claims arising from your trading, your use of the Service, or your breach of these Terms.
13. Suspension and termination
We may suspend or end your access if you breach these Terms, share your account, or create risk for us or others. You may stop using the Service and cancel at any time.
14. Disputes and governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. Any dispute relating to these Terms or the Service will be brought in the state or federal courts located in Colorado, unless applicable law requires otherwise.
15. Changes
We may update these Terms. If a change is material, we will tell you by email or in the Service before it takes effect. Continuing to use the Service after that means you accept the change.
